Terms of Service

These are the terms you agree to when you buy from AlreadyGrown. We have kept them short and in English. Where a term would be unfair to you we have left it out rather than bury it.

1. What we sell, and what the description means

We sell live nursery stock and planting hardware. Every live-plant page carries a "What actually ships" block: height, caliper, container size, root form, and how it is boxed.

That block is the binding description of your tree. It is not marketing. If the tree you receive misses those numbers, that is a breach of this contract and it is a full refund with no return required — see our Refund Policy.

2. About our product photography

Our product photography is an illustrative rendering of a mature, well-grown specimen of the species. It is not a photograph of the individual plant you will receive. The written "What actually ships" spec is the binding description. We will never claim an image is the specific plant being sent to you.

3. Prices, taxes and stock

Prices are in US dollars and exclude sales tax, which is calculated at checkout. We may change prices at any time, but never on an order you have already placed.

Inventory counts on this site are real counts of trees we actually have or have actually committed to buy. When a count reaches zero the product stops selling. We do not oversell, and we do not run fake countdown timers or invented "12 people are viewing this" counters.

If we get a price or a description materially wrong, we will contact you before charging or shipping, and you can confirm at the corrected price or cancel for a full refund.

4. Ship windows are promises

Each product states a shipping window. We are bound to it under the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435).

If we cannot ship inside that window we will email you before it closes with a revised date and a one-click cancel link. If the new date is 30 days or less past the original, you can wait or cancel — your choice. If we need more than 30 days, your order is cancelled and refunded automatically unless you tell us to hold it. Refunds go back to your original card within 7 business days. This is the FTC Mail Order Rule (16 CFR Part 435) and we would rather you use it than be surprised.

5. Pre-sell orders

Some items, currently the Sawtooth Oak, are sold as a pre-sell: you order, then we make the nursery run, grade every tree against the spec, and box it. That is stated on the product page, above the price, before you buy. Pre-sell orders carry the same 21-day window, the same delay notice, the same one-click cancel and the same refund rights as anything else on this site.

6. Risk, title and delivery

Title and risk of loss pass to you on delivery, not on dispatch. If a carrier destroys your tree in transit, that is our problem to solve with the carrier and your tree to have replaced or refunded.

Freight deliveries are curbside. Someone over 18 needs to be there to accept a pallet.

7. Where we ship

The continental United States, excluding California, Arizona, Alaska and Hawaii. California and Arizona require origin-state agricultural certification for incoming nursery stock that we do not currently hold. Those states are removed from checkout rather than accepted and cancelled later.

8. Planting, care and things trees do

A tree is a living thing and it will behave like one. Leaf drop in transit, dormant-season leaflessness, variable fall colour and variable bloom timing are normal and are described on the relevant product pages. Where a species is slow, toxic, non-native or messy, we say so on its page. Read the "Texas care notes" — especially the oak wilt rule: never prune a Texas oak between February 1 and June 30, and paint every wound within 30 minutes, year-round.

9. The Rooted Guarantee

One year, money back, your choice of refund or replacement, no photographs required, no registration, no return of a dead plant, and we pay any freight. The full terms are in our Refund Policy and they form part of this agreement.

10. Quote-only and builder orders

Mature specimens, install work and volume orders are quoted, not sold from the cart, and are completed through an invoice we send you. A written quote is valid for 30 days unless it says otherwise. Deposits on builder orders are stated on the quote.

11. Acceptable use

Do not use this site to break the law, scrape it at a rate that degrades it for other people, or resell our copy or photography as your own.

12. Liability

Our liability to you for any order is limited to what you paid for it, plus any shipping you paid. Nothing in these terms limits liability for fraud, personal injury caused by our negligence, or anything else that cannot lawfully be limited — and nothing in them takes away a right you have under consumer law.

13. No arbitration clause

There isn't one. You keep every right you would otherwise have, including the right to a jury trial and the right to join a class action. These terms are governed by the laws of the State of Texas, and neither of us gives up a court we would otherwise be entitled to use.
